If he distributed sexual videos of a minor, he would have been prosecuted for child porn. He was never prosecuted.
The fact that he wasn't prosecuted doesn't mean he didn't commit a crime; it only means that if he did, he didn't get caught.
That being said, there have been many situations where somebody (or their attorney) claims that porn is "under-age" because they want it suppressed from release–Thierry Pepin comes to mind. That tactic rarely works, because once's something's out on the Interwebs, it's there forever.
At the same time, I can appreciate websites that, out of an abundance of caution, choose not to facilitate access to material that _might _be under-age. I don't know if gt.ru "punishes" the uploader of such material; anyone can make a one-time mistake, especially if the content isn't on the "banned" list. In this age of home-made videos, it's hard to know if a "model" is under-age. But if there's a somewhat credible cloud of suspicion about a given video, it's best for websites–and users--to stay far away from it. Even an unfounded accusation of "child porn" can be very damaging to institutions or individuals.
