A question about DMCA takedowns
-
Over the course of today one user (I assume) has attempted to upload and seed around 15 torrents, all themed on twinks including videos from both studios and fan sites such as OF. I have seen, and can still see, many uploads on the site featuring the same studios and performers. Every single one seems to have been removed from the site, often within 30 minutes of being added.
I can appreciate that DMCA requests must be taken seriously and acted upon, but it seems suspicious that so many torrents from (what I assume is) a single user, spanning such a range of studios and independent performers should be jumped on so quickly. It does raise the question of whether or not this is a disgruntled user simple being a bit of an ass.
My question is if a DMCA request is received what is the actual process for removing the torrent? Does the claimant need to show that they are indeed the copyright owner? Is there a due diligence process that is followed to verify that the takedown request is legitimate? If not then presumably anyone could spam the site with random DMCA requests, decimating the list of available material.
I'm not looking to complain and start an argument over this. It's just genuine curiosity. I completely understand that the site needs to err on the side of caution in order to protect itself, but I just wonder if someone is abusing the system.

@frostycab the uploader's identity is anonymous to all users, only mods can see their names and uploads. Regarding to quick DMCA take downs, there are bots that constantly scrape recent uploads and looks for pictures and keywords and automatically issue notices via email. Those emails contain the link to the alleged copyrighted torrent as well as a link to its official release channel, when possible. That's all it takes for a notice to be issued. Some copyrighted content are no longer available through official channels, so they can no longer be purchased or rented, but they're still protected by DMCA.
You don't need to be the copyright owner to issue take down requests, you can act on their behalf through service contract OR have the distribution rights to the specified content.
GayTorrent actively requires all DMCA requests to be signed by the copyright owner and law firms must provide a copy or scan of their agreements signed by the copyright owner.

If the bot sends out requests for the last shares, then there are oddities in its work. For example, there is a working share with a Cole Bentley from October 10, but yesterday's share with him (21.6 Gb) was very quickly deleted

@pupkinvasya Most of the agents working on behalf of copyright holders have a database of media provided by the copyright holders against which they check for content matches (one image or a few frames of video is enough). Whether they hit a match or not depends on whether the media is in their database.
I would guess that studios or creators are not wasting time on older content that is already widely shared online and are only focussing on protecting their newer content. There will also be situations where different videos produced by one studio have different distributors and only one of those distributors is pursuing copyright claims.@frostycab there are many reasons besides DMCA takedown requests why torrents get deleted. I can't comment on the torrents in question here, but an awful lot of garbage gets uploaded here on a daily basis (no proper title, no description, no preview images and so on). It's far more likely for torrents to be removed because of rule violations than for DMCA takedown requests.

"October 10" - means 10/10/2022 - it's only been a month, it's not old
of course it's very good that it's still here

I don't know what that torrent is, or how old the video is, but 10/10/2022 is when it was shared on this site, not when it was produced or originally released. By "older content" I was referring to when it was produced, not when it was posted on this site.

@drekkin Ok, I get what you mean. I don't know the production date of the video too

The bots (or human parties) are far from perfect. Here's one amusing example: Back in the dawn of time I uploaded a torrent with a single .mp4 file of a full-length film. It was on this site for several years, and then I got a message telling me that it had been taken down. However, a native DVD version of that film was still on the site, and remains to this day. Apparently the bot/human did not find that one.

I had a torrent removed within the first 3 minutes of upload. The files had numbers, thumbnails were created by me, no name was provided. Do you guys believe there is also a user infiltrated here ? The frequency of these DMCAs makes me reluctant top upload.
-
@mihaig110 You just named a few features of a poor quality torrent. There's no chance a DMCA take down could happen in under 3 minutes since they're only responded via email and they're not automatically fulfilled. Likely the moderation deleted your torrent for lacking information, having too many similar pictures or something like that.
-
It is crazy, how many torrents that get taken down now. It is all over the place. Before it was only a few companies that were taken down fast, now it is evey companies that get taken down. And onlyfans stays only for a few hours. It would be nice, if we got an explanation for this. And what videos that are okay to upload.

I think it's "okay" to upload anything that satisfies the site's rules (https://www.gaytor.rent/rules.php#102) and isn't banned (https://www.gaytor.rent/notallowed.php), although it might go away very quickly.
That said, it's a lot of work for moderators to get a takedown request, verify it, and then delete the torrent. I would understand if they were to say, "Don't upload stuff from <some studio>.com, because it creates a hassle for us." Thus far, though, they haven't done that.

It's a bit off-topic (yet germane to this thread), but I'm wondering who is utilizing the name "A Former User"?
Well over a year ago, I was friends with a member (of high Reputation) who self-changed his original name to AFU, which is generally a no-no on this site. He has some intrinsic learning challenges, and when he volunteered for the site, the training mentorship was unsuccessful, and he left.
Just by writing style alone, I think this AFU is a different individual. It would be curious if someone picked this exact name out of the blue. And when one clicks on the name, it leads nowhere. But if it is my old acquaintance, I'd love to hear from him.
That's about it -- oh, except to say I'm not a DMCA spy, and certainly not a bot, a bot, a boat, ABBA, a b-o-ooooo-oo TTT, ab(&%&($(P**)^^&&^ ...

"A Former User"
refers to a deleted account in forum ...
Name will automatically re-create once account is deleted and result w/ AFU to continue reading what is posted ...

@mihaig110 Same thing happened to me exactly 8 days ago. The takedown was so swift (maybe 1 or 2 minutes) that no user got enough time to even attempt a connection!
As usual my torrent (2 vids) had thumbnails, description & screenshots, which usually gets through with no problem…During the 80 minutes preceding that very takedown, I had two more (older) torrents also DMCAed!
(Three unrelated torrents deleted in that short interval of time !!!)
