DMCA strikes and the 90-day suspension
-
To the people who actually believe that gay porn has legitimate copyrights, I suggest you leave this site.. because I have a secret for you, there is gay porn on this site! SHOCKING!
At the entrances to shops that sell porn, they have signs up saying that there is no admittance for anybody who is a member of law enforcement. Similarly, this site should have a disclaimer when signing up which asks "Do you think that sharing gay porn is legal?" and if the person clicks "NO", then they should be redirected to the website of the Disney Channel.

Thank you. Your suggestion has been considered and thrown in the bin. The reciprocal of your idea also applies if you feel like taking that option.

Gotta say, I've never seen that in the UK. Or Amsterdam. Or Prague. Or Spain. Or Germany. Guess they'd better all close up shop in case Buford T Justice happens to drive past while he's chasing The Bandit.
As has been said many times before, this site is not a democracy. The site owner gets to decide what happens on here. If they choose to comply with DMCA, most likely having sought legal guidance on the issue from a professional and not someone with a tinfoil hat on, then that is up to them.
We, the members, do not own the site. We are not responsible for it. The site goes to great lengths to protect its members' anonymity. The owners do not have that protection, so they can do what they like as far as I'm concerned.
As I said, even if there is some bizarre law or statute wherever you are, that has limitations. Porn can be and is copyrighted in many countries, and that copyright is applied to all signatories of the Berne Convention, including the US.
A (fairly long!) article on porn copyright on Lexology reads:
"Similarly, a French court[28] recently held[29] that copyright will not be denied to pornographic work only because of its genre and that the choices governing the design can be considered as original for copyright purposes. In the Australian case Venus Adult Shops,[30] dealing with copyright infringement of pornographic films, the Federal Court held that there is no statutory basis in the Copyright Act 1968 to refuse copyright on the grounds of content or offensive subject-matter of the work in question."
Regarding the UK it goes on to state:
"It is therefore reasserted that copyright law should acknowledge automatic and content-neutral creation of copyright for all works satisfying the legal requirements of copyrightability, including those at the verge of illegality (such as pornography), since the societal value judgments, including morality and public interest, are constantly developing in time and space; and that correspondingly, copyright should serve its "expressive value for society"[39] by promoting free expression or challenging these value judgments."
Now please do tell us all how your US-centric ideas trump the laws of other countries.

@frostycab What a pile of manure.
What are you doing here, if you believe that the content of this site is illegal? It isn't.
Also, who gives a damn about Germany, France, Spain, etc. They are all fucked and in the toilet. The US will be joining them in the toilet if we get 4 more years of Brandon.

@lololulu19 Please take your politics to the politics section.

@lololulu19 is correct that obscenity can not be copyrighted in most western countries.
The dispute comes in on what is considered obscene.
Porn is legal in most western countries, with some exceptions on type.
The US used to ban fully naked men, but now they allow gay porn.
The UK used to have a law that banned erections more erect than the UK was on a map. That law changed sometime around John Major and Tony Blair. Tony Blair criminalized porn that was previously illegal, such as female ejaculation.
He also banned any porn that degraded women, but the same porn that degraded men is still legal. Porn where a woman is shit or pissed on is illegal, but the same happening to men is legal.

No comment on the legal v illegal chat taking place. I just thought I'd add some info to the DMCA strikes and suspension I originally posted about.
The only thing I have uploaded recently was a set of thumbs from a large OF post someone posted without thumbs. That post is still active. Also a CB show, that is still running strong as well. Prior to that I haven't uploaded anything in 39 weeks.
1 week ago I received a notice saying something I uploaded 1-2 years ago was removed and 4 days ago I got another notice for something that was old to be removed. Two strikes, just two.
Today I downloaded the Garrett Nolan torrent and saw people were asking for thumbs so I created some thumbs and just went to upload them. Turns out two strikes gets you suspended now. I'm on my 4th 90-day suspension LOL

@tnar (and all others): If you click on a user's name, it will bring up their profile page. One can then click on the three vertical dots, and select "Ignore User," which I have done for a few users (including one beginning with "L") so that I don't have to read anything she/he/it posts. It's always the same thing, and I don't need to read it again.
As a related convenient feature of the forums, one can also block specific forum categories, which I have also done.
-
@eobox91103 the ignore feature here, as with most online forums, is a useful tool. However, there are some users you can't use it on, like mods/admin. Usually, I treat forums/chatboards like I treat my daily life...I can ignore a crazy uncle at a family meal without cutting them out of my life. I can ignore a person spouting nonsense on a train. I can ignore a person on TV telling their usual lies. For me the ignore feature is about removing clutter. If there is a person on any forum that dominates a topic/thread/board with just complete BS, click and done. Trash is taken out
-
@duncanlem Making thumbs for other uploaders who were too lazy to make thumbs. Instead of gratitude, you get suspended. No good deed goes unpunished.
-
@raphjd Perhaps when people apply to join this site, they should be asked simply: "Does your country uphold that gay porn can be legitimately copyrighted?" The answer to that for the USA is no. I can't speak for other countries, nor do I care. If someone says "YES" then to protect themselves, and this site, their application needs to be denied.
As for women getting pissed on... seems to me that a woman's orgasm is a release of piss - or at least whatever is squirt out is indistinguishable from piss.
As for scat, I dont' want to see any shit, I don't want to even see shit stains nor hairy cracks that LOOK like they might contain Klingons.
-
@lololulu19 The thumbs were not reported. the things I got strikes against are old and actual videos. But yes, no good deed...
-
You can ignore specific groups as well. That solves most of my issues with clutter.
-
User block works great, wow!
Still, to me at least, when somebody spreads shyte, can be fun to counter it I still block no one.
-
@rnd256 excellent suggestion however after this current suspension they lost me as an UPLOADER I will continue to seed forever on my various machines but the risk of removal just to help upload is no longer worth it.
-
@dat1hungdude I thought about the same thing... but I continued to upload the best videos I had anyway. But, I can't upload anymore even if I tried.
