DMCA strikes and the 90-day suspension
-
So, I'm on my third 90-day suspension for having material I posted removed for 5 reported DMCA.
I'm curious though as to what the trigger number is because it keeps changing. My first suspension was because I had over 25. My second suspension listed it as 7. This one has me at 5.
I post lots of big organized OF collections of popular models. After this suspension, I no longer will. I looked around and don't see a post on the topic that give a clear answer. What number of DMCA strikes triggers the suspension?
If this has been discussed please point me to the thread. Thank you.

@duncanlem ...
repetitive posting of Taken Down content will lead your account privilege @risk ...DMCA POLICY AND PROCEDURES :
The site has the right to terminate the account of repeat copyright infringers.SEE : https://www.gaytor.rent/dmca.php

@john32123666 I'm not questioning the site's right to do whatever they please. I'm just curious why the number fluctuates and if there was actually a trigger number written in stone.
It is important to know because in the future if I ever share again, I won't post Model A gets fucked by Model B, Model A gets fucked by Model C, model A fucks Model D, and risk Model A reporting 3 uploads, that is three strikes. I'll just upload them as a set and only risk one.

@duncanlem Unfortunately, mods and other staff do not have access to this information, so we cannot say for sure.
-
@duncanlem I am not going to repeat the fact that gay porn is legally considered obscene and therefore cannot be copyrighted - because I have pointed that out many times already.
It looks like you were suspended for posting OnlyFans content. Perhaps this site should just ban certain content - such as everything from OnlyFans - instead of invoking fake DMCA reports. Obviously if one video from OnlyFans violates the fake DMCA reports, then all of them do.
That does not bother me much, because OnlyFans has become a scam to take people's money, and instead of giving them what they pay for, they are then given censored versions of content, which requires ADDITIONAL payment. Even then, the uncensored versions are almost always solos, very short videos, very low quality videos typically recorded on cell phones, and lack any passion or penetration. Even the OnlyFans performers complain that the content they post gets REMOVED by Onlyfans for being too "explicit".
I notice that Miss Reno Gold has not put out a single video in 2023. She must be fed up with Onlyfans as well. In fact, from experience, I know that the people who post complaints are usually... OTHER PERFORMERS! If Model A is posting R rated content, while Model B is posting XXX rated content - Model A is going to try and prevent Model B from posting XXX rated content.
One other thing.... in an ironic twist... content that is NOT obscene IS covered by copyrights! So, a video of two guys fucking ass and cumming in each other's mouths is NOT covered by a copyright because it is obscene... while videos of the same guys posting in a jockstrap is not obscene - and IS covered by a copyright! Frankly, there should be a ban on NON-SEX videos!
One last point which is important - just because something is obscene does not make it illegal. Something obscene is not eligible for a copyright.

@lololulu19 I don't think GT wants to do away with OF content. They are just honoring the wishes of the content creators when they report that their material was posted. Searching the site you'll see that there is OF content that has been up for ages. Hell, I have OF torrents I created 1-2 years ago that as still going strong.
I thought about it quite a bit last night and this third suspension has made me decide to stop uploading torrents here. I'll continue to enjoy the site and seed torrents I download. I'm just not going to originate any new content. I'll leave the new uploads to other folk and there are PLENTY of people uploading new stuff daily.

I found a TAKEN DOWN video on this site! Should I report it?

@duncanlem plenty of people uploading GARBAGE, let's face it.
Regarding to OF content, each creator has the option to pay to have their content monitored all over the internet and removed just as soon as they are uploaded ilegally.
-
@duncanlem thanks for posting on the DMCA strikes bc as a long time uploader and downloader I never encountered any type of suspension until this past year and going forward. To my understanding this was a SHARE site and to to the very nature of sharing storebought or however you obtain is "illegal" but we do it here. Anywho while I wait out this latest suspension I will continue to support the room and SEED indefinitely however my UPLOAD DAYZ ARE GONE I am not gonna play the risk game only to lose my rites in the long run.

@dat1hungdude In addition to a DMCA policy, a site such as this should also have a Repeat Infringer Policy. It does not need to be public, and can be an internal document, but it should govern the actions around users who repeatedly upload copyrighted content.

This is interesting information--and new to me. Is it linked to anywhere in the rules or elsewhere? Having a page of policy that nobody can get to isn't helpful.

You're trolling, right?

@eobox91103 It's right below the link for the helpdesk in the support dropdown

Thanks; I see it now, but what an odd place to put it. I would have simply appended it to the "Rules" page. New users might not know what "DMCA" means, and could easily miss this stuff.
A good maxim for web content is "Don't just post something so that users can find it; post it so that users can't miss it."

Uploading porn does not violate copyright law since porn cannot be copyrighted because it is considered obscene. However, content containing minors is illegal in it's content and cannot be produced, sold, distributed, possessed, or viewed. The intent of that law is to protect children, and they define minors as anybody 17 or under. There have been a few 17 year olds in porn which caused a tidal wave of controversy such as Brent Corrigan aka Sean Paul Lockhart aka Fox Ryder, Traci Lords, Oliver Krist, and others. Then a wave of trolls started attacking any performer who even LOOKED young, even if verified to be 18 or older. This caused a problem for Staxus. It is commonplace for STRAIGHT porn to portray girls who look underage but get away with it, and also asian females tend to look very young, but that is overlooked too. My solution to that is to ban all content containing females. Meanwhile, the site gets flooded with content from the completely legally copyrighted "Ru Paul" and a load of non-pornographic themed movies which are legally copyrighted.

Repeating this ad nauseum does little to change anyone's mind. As I've pointed out on several occasions in the past you seem to be under the impression that something you've read online somewhere applies globally. Even if porn couldn't be copyrighted wherever you are, that does not mean that anything in other parts of the world.
-
@frostycab if there is no USA copyright, then there is no copyright.
I agree that repeating something ad nauseum does not make it true. The issue of DMCA takedowns due to copyrights has been mentioned hundreds of times here. I have pointed out several times that those ad nauseum, baseless assertiions are nonsense. If they were true, this site and at least 3 other major gay porn torrent sites would not exist.

Wow....
(Sorry about the late response, but I had to nip down to the doctor. He told me I'd strained my eyes by rolling them too hard. )

[smh] ... even if images such as photos you taken/posted online are [still] subjected to copyright or protected by law ...
