      The Ohio State Supreme Court has ruled that landowners are not liable for injuries of those injured by their mailboxes, even if the mailbox is fortified.

      The majority said that even though mailboxes are on the public "right of way" (aka public easement), it is not on a part that is normally traveled on by vehicles, therefore there is no duty of care toward vehicles and their occupants.

      In a previous case, it was decided that mailbox owners had no duty of care to cyclists, pedestrians, etc, as long as the mailboxes are legally placed.

      To recap;

      In Ohio, as long as you legally place your mailbox, you have no further duty of care.

      Other states may have different laws and/or rulings.

        Just guessing here: someone hurt themselves, or their car, on someone's mailbox - and they sued the mailbox owner?

        Proof that lawyers will sue over ANYTHING!

        The lawyers who brought such a suit should probably be sanctioned...

        No, if you put an IED under your mailbox, that might be something... LOL Just being a Devil's Advocate! 🙂

          Correct.

          The driver of the truck was injured. I think he became paralyzed.

          He was speeding around a corner, hit black ice, and hit 2 mailboxes, one of which was the one in question.
