DMCA Takedowns
-
For the longest time, I have heard rumors about DMCA notices being given to the site that are totally fictitious, are submitted out of spite, or are just outright wrong. For the longest time, I didn't want to believe this, however recently, something has happened that has left me wondering how legitimate the DMCA process really is.
Get this… The other day, I received a DMCA takedown notice FOR MY OWN PRIVATE VIDEO!!! That's right!!! A PRIVATE HOME VIDEO that I MADE MYSELF was the target of a DMCA takedown request. Imagine that... Apparently, my own private videos are copyright of some studio? SHIT!! When did that happen?! When do I get paid for whatever studio it was that had my video taken down for having apparently purchased the rights to my video?
Now I'm calling out to other users... Has anyone else received a DMCA takedown for THEIR OWN VIDEO?
It was a PRIVATE HOME VIDEO of myself, that I had filmed myself, which I subsequently published myself as the creator of the video... I just don't understand this process anymore. I had heard that fisting videos of all sorts were being taken down, and the other day, I finally got proof of that... Imagine that... My own video that I created myself and posted myself being taken down by DMCA... It really makes me question how legitimate this process is, or if it's just a cash grab for someone...

I was wondering who that was with the 10 inch cock in that homemade video!
I have mentioned DMCA irregularities in the past, especially when at one point damn near EVERY torrent was being taken down. These days, almost none seem to be taken down. I've noticed that anything >>> I <<< post almost always gets removed. In fact, I think I just thought of a way to prevent my troll from doing that any more. Hmmm…..

That's rather messed up. Each DMCA Notification should have a copyright owner who asserts claim to the video though, so you might be able to use that info to track themd own
-
Also, for a ten inch cock, I would laso claim it as my own. Just saying :cheesy2:

It is odd now that you mention it. I had a DMCA takedown of a video from a studio where there were at least 30 other videos in the database. However only my video apparently was removed. When I sent a message questioning this, I never got a reply.

DMCA refers to the USA only. If this website is not run from inside of the US, there is no DMCA, though there may (and probably are) similar laws in the hosting country, or it may simply be a website rule

Not quite true.
There's a YouTube lawsuit in progress where a British YouTuber used only about 30 seconds of an American's YouTube video under the "criticize" part of fair use. He's being sued in NYC for copyright.
++++
As for the rest of the conversation, it's getting very strange. I don't know if Joker (site owner) keeps logs of the DMCA, but if not we need it.
I do have a feeling that some people are completely abusing the system for various reasons. It seems that some people are using DMCA against their "enemies" on the site, while some don't like the content, etc, etc, etc.

Yes, I would like this. Some time ago I had a "themed" torrent with scenes from many different studios taken down because of a DMCA request. I asked what studio complained, but never got a response from staff. Is any record kept?

I was so excited when I uploaded my first torrent because I wanted the 600 bonus points, but it got deleted before I could even contact a moderator. Now there's a torrent with literally EVERY video from that website and it's still there. Ugh. (I'm not complaning about the fact that it hasn't been deleted but the fact that it doesn't make sense and now I don't feel like uploading anything else).

Maybe some website that charges a monthly subscription fee posted your video on their site and they wanted your video to be exclusive to their site so they had it taken down here. Obviously that was a fraudulent DMCA request. I wonder how many DMCA requests are legitimate or if they are even being verified? If some studio is selling your private video, you could sue them. Sharing is not illegal. If a neighbor invited you over to watch a pay-per-view event, there is nothing illegal about that. But if the neighbor charged you $20 to watch a pay-per-view event that he didn't own, then that would be illegal. That's like the Uber and Lyft and other taxi services. You can give someone a ride and even charge them for the gasoline and that is legal. But if you start a for-profit business out of driving people around, you must set up a business and have all sorts of licensing, liability, insurance, taxes, and other crap. That fraudulent DMCA request of your homemade video is like your neighbor taking your car without permission and using it to make money by driving people around town.

Just to let you know, there is a DMCA counter claim process. I've used it before on the community that I host from DMCA Notifications that are sent to Google.
