When is a duplicate torrent not a duplicate torrent?

So when is a duplicate torrent not a duplicate torrent? The rules say that a duplicate torrent must be the same size and movie format in order for it to qualify as a duplicate.
But if any mods read this what would your thoughts be:

5.45 gig in size for 29 files (4 jpegs missing from the original below making this file 1 meg smaller)

I'm not a torrent moderator but I think that it would be considered as a duplicate because it has similar size (<10% differece). Also, the third point of the rule number 9 in the Uploading Rules section says:
@Uploading:A collection may overlap with another collection if it has a different central theme. For example, a collection may include a studio series from #201 to #239; with some duplicate files found in a collection about a specific actor; or a resubmission of a site rip after 3 months in order to keep it updated.
Your collection doesn't have a different central theme, actually it is the same plus 4 pictures…

I confirm, that is a duplicate as how we see our rules. The 4 missing (or additional) images don't make up for enough difference.
Our rules allow duplicates with collections. Nevertheless then conditions must apply:
- Different well defined common theme
- Not a subset of an elder collection, unless update of a running series after 3 months
- Single movie/clip torrent part of collection(s) or taken out
None of above applies in this case.
There are cases where multiple video file torrents are not considered collections:
- Multiple discs sets (typically 2 discs sets)
- A movie split in scenes vs the full movie in one file
- A movie file split in short chunks vs one file
I'd like to add, that often "collections" lack a well defined common theme and are rather random packs. We currently don't run a "hard" line against such torrents, but those packs is not what was intended to allow by removing file number and size restrictions. There will be a change soon or later …

It's interesting to note people's enthusiasm and thoroughness in the "creation and uploading" part of torrenting (which if successful, allows the possibility for credit) and then contrasting it with the lack of enthusiasm and thoroughness in the "checking for duplicates before uploading" part of torrenting (which if successful, denies the possibility for credit).

I think many miss this point.

If a movie/clip/scene is uploaded as part of a collection that same movie/clip/scene cannot be uploaded separately, bu the reverse is not true..

Has that rule changed in the last 12 months? What you say seems the logical thing to me, and I see that kind of upload all the time, but about a year ago jackny explicitly confirmed to me that the opposite was true - clips that are posted on their own after they were previously posted as part of a collection are not considered duplicates.

That is how I am reading the rule and it makes sense. A person and choose to only download that file from a collection so another torrent that is just that single file would seem to be a duplicate as long as they are the same size and format.
Right now they are claiming things are duplicates if the first has photos along with the videos and the second just has the same video files. So what would be the difference.

That is a condition under which "duplicate" files shared by a torrent are allowed as said in my original post.

Example of identical torrents:
Torrent #1: Upload date 2015-03-02
Torrent #2: Upload date 2015-05-10, Original upload date: 2012-04-24Does that make sense? In this situation I would report torrent #1 because torrent #2 has an original upload date well before, even though the upload (refresh?) date is AFTER torrent #1. Am I correct in reporting torrent #1 in this type of instance?

Yes, #1 will be the one to be reported as duplicate to #2, which was originally uploaded before #1.
If you are sure, just re-report it.

If everything else matches and we are just determining which was uploaded first. What needs to be taken into account is who added the original upload date on torrent #2. If they were put there by the uploaded then #2 is the duplicate.
Usually a torrent with the dates as in #2. The dates are done by the staff and that would make #1 the duplicate since it goes by the original upload date.
