    Gay.Ru received a take down notice regarding a torrent i uploaded.

      Hi

      I was just wondering - i have only ever uploaded one torrent to Gay.ru and they just received a take down request regarding it.

      Is this common for Gay.Ru to receive a take down notice for uploaded torrents ? I'm just a bit confused as to what makes one torrent infringe copyright and not another ? I also notice there are also two other versions of the same film ( 'Doing It' (Vintage porn) available here so what logic would make one targeted for a take down request and not the other two versions ? Is this a sign of a spurious request or am i missing something ?

        Take down requests need to include quite some information about the owner of the copyright (real name, address, e-mail, telephone number), the agent and the copyrighted works etc … see the "DMCA" page. That should reduce "spurious request".

        Takedown requests should provide links to the alleged infringing content to be taken down.

          Any idea why they would only seek to request a take down of one version of the available copyright infringed material and not request all three versions ? Aren't the investigators who submit the take down notice able to access the Gay.ru website and it's search facilities and able to see that the material is replicated three times in Gay.ru torrent listings ? If so, why only request the take down of one of the available versions on the basis of copyright infringement ? It doesn't make sense unless they use another method to track copyright material which doesn't involve accessing the Gay.ru website perhaps ?… I'm just trying to work out the logic behind what happened.......

            There is no logic. Only the owners can answer your question why they request some and not other torrents.

            GayTorrent.ru got often open signup periods and if not open signup, an invitation system. Therefore any owner or agent can get an normal user account if he wants and use the "Search" on site. GayTorrent.ru as a legal service has no need to restrict access. The restrictions in place have all as target to prevent circumventing the minimum ratio requirements through multiple account creations.

            It is, BTW, an illusion that invite only sites provide an protection against owners and agents. They can always buy an invitation on some torrent invite sites and get in, if they really want.

              I think i worked out what happened here:

              A couple of months ago a member commented on the take-down torrent to ask me to reseed the file requested to be taken down. I pointed out i uploaded it some 5 years ago and wasnt sure i had the file but i also pointed out the file currently was available in two other torrents. He replied saying something about resolution and quality which i didn't think sounded right.

              I think the member who approached me to ask me to reseed that file may have been a copyright agent trying to set up an event where i can be detected seeding the torrent so he could send me a demand for payment notice. Failure to secure a caught-in-the-act event may have led him to have to conclude the investigation by requesting the identified file to be removed. The record of the torrent comment exchange i can access only allows me to view my replies to him. I note in one of the replies i say 'you'll know better than me' because i noticed his profile showed him to be a member with an important status. I'm presuming a moderator or some kind of power user but i think for me to actually say 'you'll know better than me' he must have been a mod. Also i think i remember seeing his user stats showed very high user ratios which suggested he was a prominent user.

              I also have an invite link posted at a popular gay website, so an agent may well think of a member who posts an invite link elsewhere on the web as a high category to investigate. My invite link connection explains why it appears such an oddly isolated incident. He could view my profile as a member and observe any indicated uploads. I also just looked at the two files which remain available on Gay.ru and i notice that the uploaders are indicated as anonymous. My version of the torrent indicated my member user name as the uploader.

              If i am correct in identifying the described tactics which were used then it appears obviously preferable to upload as an anonymous user.
              If members are posting invite links around the web they may need to be careful of their seeding activity while their link is active.
              The agent, in the first instance would appear to be spending their time prioritising the tracking and setting up of members/instances where payment demands might be most successful rather than requesting torrents be taken-down par-se. This suggests that it's all about money-chasing and not copyright in the first instance.

              Lastly, where my IP address is located is in a country where payment demands for file sharing accusations are a bit discredited and not entirely taken seriously by the legal establishment. They are known to be subject to scams so i'm not sure what authority receiving a payment demand here would have held.

              Anyway i think this is what has happened and it seems to provide a good explanation for the reason it has suddenly occurred. But obviously I cannot fully corroborate the idea.

                The same just happened to me.

                Those were totally unrelated torrents (BangBangBoys and Rocky Candy's His Mother's Lover), and of all my 6 uploads here the only ones left.

                Unfortunately take down notices are common here.

                    I think you are over afraid here a little. No member (except torrent staff) can see the uploader names. Only way an agent or owner could know the uploader name, would be the uploader marking it in the torrent description, a torrent comment or in the forum himself.

                    This is valid even with the lowest Profile privacy setting "normal", where the Profile still got a PM button. The other two privacy settings haven't even a PM button and show nothing more than the account name, it's ID (in the page link) and the selected country flag (any country from the list can be selected, e.g. a total different from the real residence).

                    The SBP earned through referral link sign-ups are invisible to other members than staff, too. Only the total SBP is visible aside a forum post.

                    What GayTorrent.ru recommends is to use a VPN or proxy for torrenting to hide the home IP from the other peers.

                      No, not dead at all. I seed all my uploads no matter how old they are.

                      Also I received a system pm regarding both take down requests.

                        thanks - i was wondering about those privacy settings and useful to know about the SBP. So you seem to be saying the uploader is always indicated as anonymous on this site. On the 'other' gay torrent site that is not the case so i may have been confusing the two.

                            i was referring to gay-torrents.net - i often identify certain uploads by uploader name & their torrent info page style / i also use OGTN …...
