How is the black list handled?
-
When I look at the blacklist, I see familiar titles, or titles that pretty much every community forbids ( Bleisch, Poolboy's Dream, etc. ) because of documented evidence of the presence of underage models in them - which makes their ban completely understandable, necessary and, you know, moral. Yet, I also see studios like TBW and Big Fun House, which are not known for having been to court or anything like that. AlexBoys used to be on list as well, but it has been removed. And it leaves me wondering: how do the administrators determine what studios have underage models in them if they put out random ones who have not been brought to courts? Is it based on received warrents, researches, found legal documents or just, you know, hunches and ''wow, this one doesn't look legal''?

You must speak about another black list than ours, because TBW was and isn't on it. If a torrent is reported for underage content, we usually do some searches. For BFH, searches should allow you to find evidence that they had underage performer content.
First thing we look at, is if known, the USC 2257 statement of the origin site / studio. If that is good, it should be enough to stay. However, some sites provide not sufficient statements saying in essence "we are user provided content site and as such don't responsible", then we take down the reported torrent if the performers look doubtable.
We get many reports for underage content, simply based on the look. These are from users used to the athletic / muscular type of US American college "men" 18+ to early 20th's like you find in CF clips, reporting clips from studios specialised in the younger boyish looking type of performers like for example seen in the 8teenboy clips. Both are same age range, but the perceived age is different. It is what makes decisions just based on look so difficult.
However, if we can't determine the origin and the look is too young, the decision should be a take down.

The original Big Fun House Productions was shutdown because it harbored underage models.

In this context (though not exclusively) falls as well a quite recent "Home" page announcement:
"2013-05-14 - Upload Information Please remember to submit basic information with your uploads. This includes: Title, Cast, Studio and General Description. More is better. This helps in cataloging torrents, checking for duplicates and users being able to search for what interests them. We make an effort to remind uploaders to edit and add this information. Those that remain unchanged and non-descriptive will be subject to deletion."
so you can except a kind of late spring cleaning …

Aracna –- are you attempting to advocate for the inclusion of studios or material we have deemed inappropriate for the site? What is the basis of your questioning, except to perhaps ready for an argument of wanting certain material included? Please then, state your request.

It's not about advocating or arguing, it's mostly because I was not aware of how these policies were inforced and was curious. Especially since some things I want to get are on it, and I was wondering to which degree these allegations were serious - I mean say that I get something from BFH, and it happens to be illigal porn and I don't know about it, I could get in serious trouble if I get caught and legally, wether or not I intended on getting underage models doesn't matter as long as it's there. So I wanted to make sure the list was right and followed strict proofs. Also, I do want to upload things from Alexboys, and I guess I will not have problems since the name has been removed from the list, but I'm still curious as to why it was on it to begin with, and want to make sure I won't have problem with staff after it's uploaded.

Alexboys was never on our black lit to my memory … what we could find to be underage while investigating will never be removed.
Something not being listed isn't a positive confirmation for not being underage. It just means there wasn't a report which got confirmed.

I don't recall us having Alex Boys on our ban list either. If it's not on our ban list, you're good to go.
Every once in awhile we have an uploaded video with younger-appearing actors – if other users question it's appropriateness on the site, we'll research it. That's one of the reasons it's important for uploaders to submit basic information about their upload. If upload in question comes from a general tube site and/or we are unable to identify it as originating from a studio with age compliance policies/reports of misuse, we will remove it to err on the side of caution.
Reviewing the AlexBoys site and doing some general research into any reports of underage actors, it appears good on our end. It's material from generic tube sites that are usually more of an issue.
