The Babbitt estate brought a lawsuit against the US government under the Biden administration and alleged that Byrd was negligent in his use of force and firing his gun at Babbitt.
..."Ashli was unarmed," the suit said. "Her hands were up in the air, empty, and in plain view of Lt. Byrd and other officers in the lobby. Ashli posed no threat to the safety of anyone."
Reports from Biden DOJ & police cleared him - falsely, as cover-ups.
the officer, who was not in uniform, failed to de-escalate the situation and did not give her any warnings or commands before opening fire.
